Podcast City Terms and Conditions of Use

Overview

By using the facilities and services at Podcast City, you (the client) agree to the following terms and conditions. These ensure a clear understanding between Podcast City and our clients, and outline your responsibilities, our services, and legal protections for both parties.

1. Podcast City’s Responsibilities

  1. Podcast City acts as a facilitator for clients in producing audio and/or video podcasts, recordings, live streams, and related services either in our studio or via our mobile setup.

  2. We provide the equipment, software, and technical support required for services such as:

    • Studio hire and mobile studio recording

    • Audio/video recording and editing

    • Live streaming

    • Podcast upload, show notes, artwork, transcripts

    • Intros, outros, trailers, royalty-free music

    • Ads, media training, podcast training, and social media content creation

  3. Clients agree to pay all associated fees for services provided by Podcast City.

  4. Work is completed according to the work order form, email, or written instructions.

  5. All services will be quoted in writing prior to commencement.

  6. For DIY sessions, a sound engineer may provide setup guidance; however, clients are responsible for operating equipment during their booking.

  7. Podcast City provides professional guidance, but clients have the final say in content creation.

  8. Clients understand that they are solely responsible for their published work. Podcast City acts only as a service provider.

  9. Final recordings (audio/video) will be delivered after full payment is received. Files will be delivered electronically or on a storage device provided by the client, at Podcast City’s discretion.

  10. Podcast City reserves the right to decline services or refer matters to legal professionals where there is potential legal liability (e.g., defamation or breaches of law).

2. Client Responsibilities

  1. Clients must provide clear instructions on how they wish their content to be recorded, edited, and distributed.

  2. Clients confirm they hold the legal rights to all content used, including third-party material (music, clips, etc.).

  3. Clients are responsible for ensuring their content does not infringe on others’ intellectual property, privacy, or publicity rights.

  4. If using content under ‘fair use’ provisions, it must be declared in the recording and noted in accompanying materials.

  5. Content must not include discussion of active legal cases or identification of persons involved in legal proceedings.

  6. Clients must not include defamatory, harassing, false, or misleading content, or statistics without credible sourcing.

  7. Podcast City reserves the right to refuse, withhold, or delete any content that breaches community standards, is unlawful, or violates our Code of Conduct.

  8. Clients must indemnify Podcast City, its staff, and affiliates against any legal claims, damages, or losses arising from their content or actions.

  9. It is the client’s responsibility to obtain signed release forms from all guests. General release forms may be available at the studio, but Podcast City takes no responsibility for their legal sufficiency.

  10. Clients agree to pay all fees for services used.

3. Ownership, Copyright & File Handling

  1. Podcast City retains ownership and copyright of all recordings (edited or unedited) until payment is made in full.

  2. Once payment is received, ownership and full rights are transferred to the client.

  3. Recordings are stored securely by Podcast City for editing and backup purposes. However, we are not liable for missing, damaged, or unreadable files.

  4. Clients may request stored files via the provided download link, email, or written request.

  5. Files are kept for 6 months, unless requested to be deleted earlier. Clients are encouraged to keep their own backups.

  6. We will not release your recordings to any third party without your written permission, unless legally required to by Australian law.

4. Fees and Payment

  1. All service fees are listed on our website or available upon request via our price guide.

  2. Prices are subject to change; clients will be notified in advance of any updates.

  3. Packages are honoured at the agreed price until the stated expiry date.

  4. Accepted payment methods:

    • Credit/debit card

    • Bank transfer

    • Cash (exact amount only; we do not carry change)

    • Approved invoices (by prior arrangement)

  5. Full payment is required at the time of service, unless pre-approved alternative arrangements have been made.

  6. All prices are quoted in Australian Dollars (AUD).

5. DIY Studio Use – Important Notes

  • When using the Podcast City studio under the DIY model, clients are responsible for:

    • Starting and stopping their own recordings (audio and/or video)

    • Monitoring the session to ensure quality and performance

    • Ensuring correct use of equipment provided

  • Once Podcast City staff leave the room, we do not take any responsibility for errors, missed recordings, or technical issues.

6. Legal Disclaimer

Podcast City operates in line with Australian Federal, State and Territory laws. We reserve the right to refuse or discontinue service if we believe any content or behaviour may place us at legal or reputational risk.
