Podcast City Terms and Conditions of Use
Overview
By using the facilities and services at Podcast City, you (the client) agree to the following terms and conditions. These ensure a clear understanding between Podcast City and our clients and outline your responsibilities, our services, and legal protections for both parties.
1. Podcast City’s Responsibilities
Podcast City acts as a facilitator for clients in producing audio and/or video podcasts, recordings, live streams, and related services either in our studio or via our mobile setup.
We provide the equipment, software, and technical support required for services such as:
Studio hire and mobile studio recording
Audio/video recording and editing
Live streaming
Podcast upload, show notes, artwork, transcripts
Intros, outros, trailers, royalty-free music
Ads, media training, podcast training, and social media content creation
Clients agree to pay all associated fees for services provided by Podcast City.
Work is completed according to the work order form, email, or written instructions.
All services will be quoted in writing prior to commencement.
For DIY sessions, a sound engineer may provide setup guidance; however, clients are responsible for operating equipment during their booking.
Podcast City provides professional guidance, but clients have the final say in content creation. Clients understand they are solely responsible for their published work — Podcast City acts only as a service provider.
Final recordings will be delivered after full payment is received, electronically or via client-provided storage at Podcast City’s discretion.
We reserve the right to decline services or refer matters to legal professionals where legal liability may arise (e.g., defamation or unlawful content).
2. Client Responsibilities
Clients must provide clear instructions on how they wish their content to be recorded, edited, and distributed.
Clients confirm they hold the legal rights to all content used, including third-party material (music, clips, etc.).
Clients are responsible for ensuring their content does not infringe on others’ intellectual property, privacy, or publicity rights.
If using content under ‘fair use’ provisions, this must be declared in the recording and accompanying materials.
Content must not include:
Active legal case discussions
Identification of parties in legal proceedings
Defamatory, harassing, false, or misleading information
Statistics without credible sourcing
Podcast City reserves the right to refuse, withhold, or delete any content that breaches community standards, is unlawful, or violates our Code of Conduct.
Clients must indemnify Podcast City, its staff, and affiliates against any legal claims, damages, or losses arising from their content or actions.
It is the client’s responsibility to obtain signed release forms from all guests. General release templates may be available, but Podcast City takes no responsibility for their legal sufficiency.
Clients agree to pay all fees for services used.
3. Ownership, Copyright & File Handling
Podcast City retains ownership and copyright of all recordings (edited or unedited) until payment is made in full.
Once payment is received, ownership and full rights are transferred to the client.
Recordings are securely stored for editing and backup purposes. However, Podcast City is not liable for missing, damaged, or unreadable files.
Files are kept for 6 months, unless an earlier deletion is requested. Clients are encouraged to keep their own backups.
We do not release files to third parties without written client permission, unless legally required under Australian law.
4. Fees and Payment
All service fees are listed on our website or in our price guide (available upon request).
Prices are subject to change with notice. Packages will be honoured at the agreed price until the stated expiry date.
Accepted payment methods:
Credit/debit card
Bank transfer
Cash (exact amount only)
Pre-approved invoice terms
Full payment is required at the time of service unless prior arrangements have been made.
All prices are quoted in Australian Dollars (AUD).
If you’re experiencing financial difficulty, please contact us — we may be able to arrange a payment plan.
Please note: If you have an approved account with Podcast City and your invoice remains unpaid 10 days after the issue date, a $15 late fee will apply.
5. DIY Studio Use – Important Notes
When using Podcast City under the DIY model, clients are responsible for:
Starting and stopping their own recordings
Monitoring audio/video quality during the session
Correct use of equipment provided
Once Podcast City staff leave the room, we are not liable for technical errors or missed recordings.
6. Legal Disclaimer
Podcast City operates in compliance with Australian Federal, State, and Territory laws.
We reserve the right to refuse or discontinue services if any content or behaviour may pose a legal or reputational risk.
7. Cancellations, Rescheduling & No-Shows
We understand plans change, but cancellations can impact our studio operations and other clients. Please review our cancellation policy below:
More than 24 hours’ notice – No charge
Within 24 hours of your booking – 25% of the total session fee
Within 12 hours of your booking – 50% of the total session fee
Within 2 hours or no-show – 100% of the session fee
To cancel or reschedule, please contact us as soon as possible. Changes must be made via your original booking confirmation or by emailing us directly at info@podcastcity.com.au.
If you do not attend your session or fail to notify us within the timeframes above, cancellation fees will apply.
